What is SIJS (Special Immigrant Juvenile Status)?

SIJS is a pathway to permanent residence (green card) for undocumented youth who have been abused, neglected, or abandoned by one or both parents. Unlike DACA, SIJS leads directly to a green card and eventual citizenship.

Who Qualifies for SIJS?

To qualify for SIJS, you must meet these requirements:

  • Age: Under 21 years old when you file the USCIS petition (Form I-360)
  • Unmarried: You cannot be married when you apply
  • Physical presence: You must be physically present in the United States
  • State court findings: A state family court must find that:
    • Reunification with one or both parents is not viable due to abuse, neglect, abandonment, or similar basis under state law
    • It is not in your best interest to return to your country of nationality or last habitual residence

The SIJS Process: Step by Step

Step 1: Obtain State Court Findings

First, you need a state family court to make specific findings about your situation. This typically happens through:

  • Guardianship proceedings
  • Custody proceedings
  • Dependency proceedings
  • Other family court matters

Step 2: File Form I-360 with USCIS

After getting the state court order, you file Form I-360 (Petition for Special Immigrant) with USCIS. This petition is free – there is no filing fee for SIJS cases.

Step 3: Apply for Adjustment of Status

Once USCIS approves your I-360 petition and a visa number becomes available, you can file Form I-485 to adjust status to permanent resident.
